Telangana High Court stays ban on sale of pan masala

The panel comprising Chief Justice Raghavendra Singh Chauhan and Justice B Vijaysen Reddy was dealing with a plea filed by M/s. R One Agencies challenging the order of the Commissioner of Food Safety.

Hyderabad: A two-Judge panel of the Telangana High Court on Tuesday stayed the ban on sale of certain tobacco and pan masala under Section 30 of the Food Safety and Standards Act, 2006. The order was issued by the Commissioner of Food Safety imposing ban and Food Safety and Standards prohibition.

The panel comprising Chief Justice Raghavendra Singh Chauhan and Justice B Vijaysen Reddy was dealing with a plea filed by M/s. R One Agencies challenging the order of the Commissioner of Food Safety. The petitioner contended that the Commissioner of Food Safety does not have any jurisdiction to pass an order for imposing ban on the products. It is stated that the order is against the mandatory provisions of the law.. The bench issued notice to the respondents and also ordered stay on the order passed by the Commissioner of Food Safety.
