The Supreme Court on August 4, had stayed the conviction of Congress leader Rahul Gandhi in a defamation case against him, thus paving the way for restoration of his Lok Sabha membership.

Immediately after the high court order, the Congress, which described it as "highly disappointing, but not unexpected", said it will move the Supreme Court
The remarks of the Congress leaders came after the Gujarat High Court upheld the Sessions Court's order denying stay on conviction of Rahul Gandhi in the defamation case against 'Modi surname' remark.
While dismissing the plea, Justice Hemant Prachchhak noted that Gandhi is already facing 10 cases across India, adding the order of the lower court was "just, proper and legal" in convicting the Congress leader.
After final arguments from both sides concluded during the day, the Gujarat HC of Justice Hemant Prachchhak said no interim protection can be granted to the applicant at this stage in the defamation case
