CPI MLA Sambasiva Rao to face trial in High Court over ‘improper’ election affidavit
Rao had filed an interim application before the High Court asking to quash the proceedings of the election petition, which was filed by a voter Nandu Lal Agarwal
Hyderabad: The Supreme Court has disposed CPI’sKothagudemMLAKunamneniSambasivaRao’s special leave petition against a Telangana High Court order in connection with an election petition that he had not filed his Form-26 affidavit properly for the Assembly elections held in 2023.
Rao had filed an interim application before the High Court asking to quash the proceedings of the election petition, which was filed by a voter NanduLalAgarwal. The matter was heard by Justice K Lakshman, who dismissed SambasivaRao’s application on September 18, 2024.
The CPIMLA then approached the Supreme Court via a special leave petition (civil), questioning the order passed by Justice Lakshman.
A Supreme Court bench headed by Justice Surya Kant, which heard the matter on Wednesday, dismissed Rao’s SLP, confirming the order passed by Justice Lakshman and asked the MLA to face the trial in the High Court.
