A bench comprising Justices Hemant Gupta and V. Ramasubramanian, pointing at the 100-page judgment delivered by High Court while granting bail to Asif Iqbal Tanha, observed

Order on the release of Devangana Kalita, Natasha Narwal and Asif Iqbal Tanha came two days after the Delhi High Court granted them bail in the case.

Questioning the approach adopted by High Court, the police said the three judgments granting bail to three students, Tanha, Kalita and Narwal were "without any foundation and appears to be based more on the social media narrative"

The high court directed that accused – Shabir Ali, Mehtab and Rais Ahmed – be released on bail on furnishing of a personal bond of Rs 25,000 each along with a surety of the like amount.

The court granted interim bail to Narwal, a Pinjra Tod activist, for three weeks subject to her furnishing of a personal bond of Rs 50,000.

Besides this, the judge said that it is grossly unfair and unjustified that the reporting of the exact contents of the charge-sheet are reported in the media before cognizance is taken.

A Division Bench headed by Chief Justice D.N. Patel adjourned the matter and listed it for March 26

Kalita was arrested in the case for allegedly being part of a premeditated conspiracy behind the northeast Delhi riots.

“Considering the period of incarceration of accused and in the totality of the facts and circumstances of the case, the bail application is allowed,” it said in its similar order passed on January 19 in both the matters.

Additional Sessions Judge Amitabh Rawat directed the Jail Superintendent to ensure that the accused was allowed to step out of his jail as per the rules and to ensure that the court did not receive any such complaints in future
