Hyderabad: Justice Ujjal Bhuyan of the Telangana High Court on Wednesday directed the release of BJP State president Bandi Sanjay Kumar. Earlier in the day, the judge granted permission for out of turn hearing of the matter.
Senior counsel Prakash Reddy pointed out that the lower court did not apply its mind while ordering judicial remand of the petitioner. Even as the public prosecutor stood up to oppose the petition, Justice Bhuyan pointed out that it was not for the public prosecutor to appear for the Judicial Officer whose order did not reflect application of mind.
On the question of whether the petitioner must file a fresh petition for bail or setting aside the remand order is sufficient, the court held that it was not without power to order the release of the petitioner and accordingly ordered his release.
UoH petition dismissed
Shameem Akther of the Telangana High Court dismissed a writ petition filed by University of Hyderabad challenging the action of the GHMC Authorities in undertaking road expansion activity in the University land admeasuring Ac. 18.30 Gts in Sy. 25 of Gachibowli. The petitioner said that Tahsildar Serilingampally handed over the said land to GHMC for the expansion of the pre-existing 6 Meters (M) wide road within the said land connecting the ISB Road and Gopanpally Thanda via the Government Employees Colonies. Earlier a single judge ordered status quo but permitted the general public to use the road. In an appeal filed by the University a division panel in February 2021 passed an order restricting the use of the road by third parties. The petitioner pointed out that the University was established in 1974 and was allotted an extent of Ac. 2324 – 05 Gts. Of land by the then State of Andhra Pradesh. The Municipal Administration has taken back Ac. 700 – 0 Gts. Of land and promised to allot alternate land to the University. Various institutions including private individuals were also allotted out of the said extent of Ac. 700 – 00 Gts. Of land said the Petitioner.
The university said that in 2003, the university was requested by the government of Andhra Pradesh to allot 534 – 28 Gts. Of land to IMG Academics Bharat Pvt. Ltd for establishing a sports academy. The said land, according to it, falls in Sy. No. 25 of Kancha Gachibowli, Serilingampally Mandal, Ranga Reddy district. According to petitioner, there were agreements between the university and the State for grant of alternate land in Sy. Nos. 34 and 37 of Kancha Gachibowli, Serilingampally Mandal, Ranga Reddy district within a period of 3 months. There is a pending dispute on the same and in the year 2006 the High Court directed parties to maintain status quo with regards to land encroachment. The State said that no new road is being laid and the existing road is being black topped. The Collector Ranga Reddy filed a detailed counter setting out all the details with regards to the extents of land falling in Sy. No. 25 and also filed a memo in January 2017 directing the Deputy Collector and Tehsildar Serilingampally Mandal to handover physical possession of vacant govt. land to and extent of Ac. 18 – 38 Gts. In Sy. No. 25 of Kancha Gachibowli, Serilingampally Mandal, Ranga Reddy district to G.H.M.C. under a cover of Panchanama. The said memo clearly indicates that till date no alienation of Govt. land in favour of the petitioner. It is also said that request from the University Registrar is also pending consideration seeking alienation of land. As per the revenue records, the said land is Government land classified as “Kancha Astabal Poramboke sarkari” and the title of the land still lies with the Government, said the authorities. After hearing the parties at length the judge dismissed the writ petition filed by the University.
