Hyderabad: A two-judge panel of the Telangana High Court comprising Chief Justice Satish Chandra Sharma and Justice Tukaramji on Tuesday reserved order on a writ appeal filed by the State against an order of a single judge in allowing a writ petition questioning land acquisition process to acquire the land for police academy. A single judge had allowed a writ petition filed by Mailarapu Jangaiah and others against MRO of Rajender Nagar mandal complaining that due procedure was not followed while acquiring land for the police academy. Senior counsel V Venkatramana, appearing for the respondents, pointed out that the Telangana government could not resume the land as the order passed in 2007 in erstwhile AP and the State of Telangana came to existence in June 2014. Senior counsel CS Vaidyanathan, appearing for the State of Telangana, pointed out that Telangana had adopted the Act in 2016 and they have the powers to acquire the land.

The same panel adjourned to April 13 a matter pertaining to alleged encroachment in Gadwal mandal, Mahbubnagar district. The panel was dealing with a PIL filed by U Krishna Reddy complaining that Tahsildar and District Collector failed to curb encroachments on cart land in Puddur village. He complained that private parties had encroached the land and built godowns. Government pleader, appearing for the Revenue Department, said that all illegal godowns were demolished. He pointed out that due to lack of sufficient godowns, paddy crop was lying in the fields. The panel directed the private respondents to apply for permission for construction of godowns with the Director of District Town and Country Planning Department within 30 days, and directed them to consider it within 60 days.

PIL on wine shops

The same panel adjourned a matter pertaining to shifting wine shops operating within 100 metres of educational institutions by 2 weeks. The panel was dealing with a PIL filed by Dr Kota Neelima. The petitioner questioned the inaction of the Excise Department to relocate the wine shops operating within 100 metres from the educational institutions, hospitals, and places of worship. The petitioner contended that the same was contrary to Rule 25 of Telangana Excise Grant of Licence of Selling by Shop and Conditions of Licence Rules 2012. The panel directed the petitioner to implead the wine shops that violated the said rule. Granting time to the petitioner to respond, the panel adjourned the matter.
