Hyderabad: The Telangana High Court has upheld the Government order that pillion riders of two-wheelers must also wear helmets.
While hearing arguments on a writ filed by a law student on Thursday, a two judge panel comprising Chief Justice Satish Chandra Sharma and Justice A Rajasekar Reddy directed that it is mandatory as per the Motor Vehicles Act that pillion riders must also wear helmets and no exemption will be given for challans.
The panel also made clear that it was mandatory for pillion riders to wear helmets on a two-wheeler. The writ filed by law student sought a declaration that pillion riders were not required to wear helmets and the DGP and the Union Ministry of Road Transport should not impose fines for pillion riders who are not wearing helmets.
Further, the petitioner sought relief to refund the amount collected from the citizens on whom the file has been imposed prior to the amendment of the rules. The panel ruled that the Motor Vehicles Act mandates that the pillion riders must wear a helmet failing which a challan will be imposed. Subsequent to this, the petitioner withdrew the case.
