Hyderabad: The Telangana High Court has directed the police department not to restrict the movement of advocates, their clerks, stenographers, typists in the entire State on certain conditions.
The court gave these directions while responding to two petitions filed by the petitioners requesting to exempt advocates and clerks from the movement restrictions during lockdown.
As per conditions, the advocates should produce identity card issued by either Bar Council or any Advocates Association registered with the Bar Council. The clerks, stenographers and typists should produce certificate with photograph issued by their advocates concerned to certify that they were working with them.
The advocates, their clerks, stenographers and typists must strictly follow the guidelines issued by the Central and State governments with regard to Covid-19 pandemic. They should not misuse the liberty granted to them in this order, keeping in view the present situation in the State and country due to pandemic.
The court has directed the department to issue necessary instructions to all the police officers in the State. “It is made clear that no officer of any authority including police and revenue etc., shall humiliate any of the advocates on production of their identity cards issued by either Bar Council or Advocates Associations registered with Bar Council failing which it will be viewed seriously and action will be taken against erring officers as per law,” the court said in the order.
In his submission permitted by the court in view of greater importance of the matter, senior counsel L Ravichander said advocates were unable to log on to the police website to get an e-Pass. He brought to the notice of court that his colleagues tried to open the website 16 times to get an e-Pass but in vain.
One of the requests to issue an e-Pass made by his colleagues was rejected by officials on flimsy grounds and thus they were facing problems because of conditions imposed by the government, he said.
