Aparna Serenity apartment owner restrained from making alterations by TGRERA

A flat owner in a high-rise construction can not undertake alterations or structural modifications which could affect the structural stability of the structure, ruled the Real Estate Regulatory Authority

Hyderabad: The Telangana Real Estate Regulatory Authority (TGRERA) has restrained an apartment owner in Aparna Serenity complex in Petbasheerabad from taking up any alteration of the flat affecting the safety and structural stability of the high-rise structure. This order was issued on April 7.

According to the order, the respondents, owner of an apartment in the Aparna Serenity complex had undertaken some alterations to their flat for which the builder company took objection citing danger to the structural stability of the whole complex.


The RERA perused the documents on record said: “the Authority is of the view that prima facie there exists a apprehension regarding the structural safety of the building owing to the alleged alterations being carried out by the Respondents and finds that the
arguments presented by complainant holds merit. The balance of convenience favors the Complainant, as their safety and well-being are at risk. Granting the interim relief sought would not cause any undue hardship to the Respondents.”

The Respondents were restrained from making any further alterations or structural modifications in violation of the sanctioned plan and the governing agreements. The Authority also directed the respondents to maintain status quo with respect to Flat No. 205 until
the final disposal of the present complaint. The case was posted for further hearing on April 25.
