The judge said, orders of the courts are not implemented by government authorities. He reminded, pointing out to Advocate General of Telangana, how all the Section 41, CrPC violations are contempt of court for violating Supreme Court directions in Arnesh Kumar judgement. Civil Court order suspended
Justice T Vinod Kumar of the Telangana High Court on Friday suspended an order of the Civil Court, Khammam, requiring the presence of Chairman and Managing Director, Indian Oil Corporation Limited (IOCL), before the court. The order is made in a revision filed by Indian Oil Corporation challenging the order of the Principal District and Sessions Judge, Khammam. The court below recorded in its order of November 15 that one Bandi Venkateswar Rao had instituted a civil suit against the Corporation and therefore, he is required to be present in person in court on December 28. The petitioner would contend that there was no cause to summon the Chairman and Managing Director directly in the dispute and the court failed to see that the Chairman was deliberately made a party to the proceedings. He would also point out that the subject matter of the suit was earlier subject matter of a writ petition where the Chairman is not a party. The matter has been adjourned to January 28 for further hearing.
