Telangana HC asks police not to insist for trainee IPS officer’s potency test

The Telangana High Court on Monday directed the investigating officer not to insist on conducting a potency test on suspended trainee IPS officer M Uday Krishna Reddy until Tuesday. The court adjourned the hearing on Reddy’s plea challenging the test.

Hyderabad: Justice J Sreenivas Rao of the Telangana High Court on Monday directed the investigating officer not to insist on conducting a potency test on suspended trainee IPS officer M Uday Krishna Reddy until Tuesday, and adjourned the hearing.

It may be recalled that Uday Krishna Reddy was arrested in connection with allegations of sexual assault and attempt to murder involving a woman colleague. Reddy had approached the High Court challenging an order of the Rajendranagar court in Ranga Reddy district, which had permitted the potency test under Section 52 of the BNSS.


Counsel for the petitioner sought quashing of the lower court’s order, contending that authorising the test was not legally sustainable, and cited a Supreme Court judgment in support of his submission, urging the Court to reject the investigating officer’s request for the test.

The Public Prosecutor argued that the potency test was a necessary part of the investigation.

After hearing both sides, the judge adjourned the proceedings, directing that the potency test not be pressed for till Tuesday.
