Hyderabad: A two-judge panel of the Telangana High Court on Thursday ordered notice to the State government in a writ petition questioning the two children disqualification norm in the GHMC elections.
The panel of Chief Justice Raghvendra Singh Chauhan and Justice B Vijayasen Reddy was dealing with writ petition filed by Sridhar Babu Ravi and Mohammed Taher seeking a declaration that Section 21 B of the GHMC Act, 1955 is unreasonable, arbitrary and unconstitutional. The petitioners questioned the clause of contestants having more than two children born after May 1955 were disqualified from contesting in the municipal elections in GHMC area under the GHMC Act, 1955.
They also pointed out Telangana Municipalities Act, 2019 dropped drown the said disqualification in all other Municipalities and Municipal Corporations in the State. T Swetcha, counsel for the petitioner contended that continuance of disqualification in GHMC alone is discriminatory in nature. She also contended that there should be reasonable classification in applying law to a homogenous group of people situated similarly.
The petitioners would also point out the continuation dishonours the agenda under the International Conference on Population and Development, Cairo, 1994 and National Population Policy, 2000. Even the fertility rate statistics does not permit such classification stated the petitioners. The panel adjourned the case to November 19 for the response of the government.
