Hyderabad: A two-judge panel of the Telangana High Court comprising Chief Justice Raghvendra Singh Chouhan and Justice B Vijaysen Reddy in a special session on Saturday morning sent the State Election Commission back to the single judge on the elections at the Neredmet ward. The modified mark was explained in appeal by the State Election Commission that the said polling booth number mark was mistakenly given in place of the arrow cross (swastik) mark. The panel, without interdicting the order of the single judge, pointed out that the factors now made available by the Commission be brought to the notice of the single judge to enable adjudication of the matter. The panel noticed since this factor was not placed before the single judge, he could not have adjudicated keeping this factor in mind. The panel then reasoned that it is therefore just for the matter to go back to the single judge. The matter is now scheduled to be heard on Monday by the single judge. As reported earlier, the single judge interdicted a late-night circular of the Election Commission on counting ballot papers with a mark other than the arrow/swastik mark. The singe judge had stayed announcement of the result if the differential votes affected the result of the election. It is against this order that the Election Commission moved the present house motion.
