On March 5, the Nagpur bench of the Bombay High Court acquitted Saibaba, 54, and others, noting that the prosecution failed to prove beyond reasonable doubt the case against him.
A bench headed by Justice M.R. Shah remanded the matter back to the high court for fresh consideration and also kept the question of law (including sanction) open.
A bench comprising Justices M.R. Shah and Bela M. Trivedi suspended the high court's judgment and issued notice on the appeal filed by the Maharashtra government challenging the order.
