Telangana HC dismisses Vanama’s plea to dismiss Jalagam’s election petition

Hyderabad: Justice Abhishek Reddy of the Telangana High Court dismissed an interim application filed by Kothagudem MLA Vanama Venkateshwara Rao seeking deletion of various pleadings in an election petition filed against him.
The election petition was filed by former TRS MLA Jalagam Venkat Rao, the unsuccessful candidate in the last Assembly elections. The election petition sought to set aside the election of Vanama Venkateshwara Rao, who contested the election on a Congress ticket, but is with TRS presently.
The petitioner Jalagam Venkat Rao raised various issues including the failure to file a proper mandatory affidavit. He also alleged that the Vanama Venkateshwar Rao submitted false information with respect to immovable assets, assets of family members and failed to disclose pending criminal cases.
However, Vanama Venkateshwar Rao moved the high court seeking striking down of various pleadings and dismissal of the election petition itself on the ground that there was no cause of action.
The judge refused such relief for the sitting MLA. He reasoned that there were triable issues from the said pleadings and the election petition must go for trial. The judge scheduled the trial to March 23.
