Telangana HC: Special centres for vaccination of LGBTQ, transgender community

Hyderabad: A two-panel judge of the Telangana High Court comprising of Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavili on Wednesday enumerated steps to be taken by the State Government to make facilities in each district for the COVID vaccination of the LGBTQ/Transgender community. The Petitioner, Vyjayanti Vasanta Mogli, filed a petition detailing the plight of the transgender community in the society.
The petitioner also sought other reliefs like providing free ration, medicines including HIV medication and hormone therapy, payment of three months social security pension, LPG cylinders and waivng of electricity bill for six months, etc. A consolidated report had been filed stating that there were 58,918 transgender persons in the State and as of August 2021 only 3,013 of the above have been vaccinated. It has been brought to the court’s notice that the transgenders have not been getting vaccinated because of a lack of identity proof. Taking this into account, the court has directed the State Government to provide a centre in each state for the vaccination of transgenders and that it shall not insist on producing an Aadhar Card for getting the vaccination. However, the court expressed that there needs to be some proof of identity for the state needs to keep a record of the vaccination status.
Drug trafficking cases
The panel directed the State Government to handover all physical and digital evidence to the Enforcement Directorate in a drug trafficking case of 2017. The TPCC presidnet A Revanth Reddy filed a petition stating that the drug mafia was carrying out operations in Telangana. The panel observed that the state did not have a specialized agency to carry out investigations on a large scale in this regard. After carrying out an investigation, twelve cases were registered in 2017 and the matter was pending before the trial court. It has come to light that the crimes registered, relate to an International Drug Trafficking racket that potentially destroys the youth of the country. The Joint Deputy Director of the ED had asked for the documents and evidences seized by the investigating agency. The court felt that the plea was genuine andstrictly directed the state to hand over all the evidence to the ED.
Pollution Control Board and HMDA asked to file complaince report on polluting industries
The same panel directed the Pollution Control Board and the Hyderabad Metropolitan Development Authority (HMDA) to file a compliance report within the next ten days pertaining to action against the polluting industries and appear before the court. The issue raised was for the cancellation of the permissions of the pharma industries in Gundlamachanoor of Sanga Reddy District. It was contended that the pharma industry’s function was contrary to the Pollution control statutes and was posing a hazard to people residing there.
