Hyderabad: A two-judge panel of the Telangana High Court comprising Acting Chief Justice MS Ramchandra Rao and Justice T Vinod Kumar voiced its disapproval at the Tahsildar of Abdullapurmet mandal and made it clear that if the tobacco units of the petitioners are not reopened by Wednesday, the court would pass orders which would be to the detriment of the said officer.
The panel is dealing with two writ petitions filed by SPR Constructions and PN Constructions who pointed out their manufacturing units of tobacco products were closed by the erring official even though the Pollution Control Board reported that they had a valid licence.
The panel wondered how the official could act in such a high-handed manner.
In a connected matter, the panel took on a file petition filed by Kamadhenu Traders. The petition questioned the power of the State government to interfere with the trade and business carried out in the tobacco products that would fall within the notification dated January 6. The panel directed that no coercive steps be taken against the petitioner pending further hearing of the writ petition.
Ordered reserved in plea by co-op society
A same panel reserved verdict in an appeal filed by Telangana Non Gazetted Officers House Building Cooperative Society Limited.
The Society challenged the proceedings issued by the Commissioner for Cooperation and Registrar of Cooperative Societies for supersession of the managing committee of the cooperative society. Earlier, a single judge refused to interfere in the said proceedings.
Security agency’s plea taken on file
The panel also took on file a writ appeal filed by Sai Security Services, an agency providing security services to Telangana Institute of Medical Services (TIMS).
The security firm moved the court questioning proceedings of the District Collector directing the cancellation of the existing contract and offering it to Nakshatra Security Services.
The panel refused to grant any interim order as the contract period had expired. It said TIMS cannot be made to run without a functional security service in place. It is further recorded that that appeal would deal with the limited question whether the termination can act as a bar on the petitioner being appointed by the government for other purposes for the next two years.
