Hyderabad: A two-judge panel of the Telangana High Court on Monday ruled that weightage of marks for PG medical courses based on the State government rules will apply only when a candidate completes three years of rural/tribal service. The panel comprising Justice MS Ramachandra Rao and Justice T Amarnath Goud dismissed a writ petition by an in-service candidate seeking weightage of marks for a post-graduate seat in the medical faculty. G Shweta in her writ petition contended that the authorities of the Kaloji Narayan Rao Health University illegally denied her a seat by not giving 10% weightage as per the government rules. The panel said that the weightage would come only in a case where a candidate has served for three years and in light of the fact that she had put in only one year service in rural sector she was not entitled to such advantage.
A two-judge panel of the Telangana High Court comprising Chief Justice Raghvendra Singh Chauhan and Justice B Vijaysen Reddy on Monday asked the State Advocate General about the facilities available for instruction in Urdu medium schools in the State. The panel was dealing with a PIL filed by Abdul Sami contending that the State cannot deprive citizens of Right to Education or deny them life with dignity and discriminate on the basis of language.
He urged the court to take notice of the discriminatory proceedings of Commissioner of School Education and Ex Officio State Project Director of Samagra Shiksha, Telangana, made on August 29. The petitioner also sought directions to the authorities for making all necessary arrangements to provide digital infrastructure and teaching staff to meet educational needs of students belonging to Urdu medium schools and junior colleges in the State.
The same panel asked the Advocate General to ascertain from the government about the appointment of Chairperson for Women Commission in Telangana. The panel was dealing with a PIL filed by Ramya Rao Regulapati seeking directions with regard to non-appointment of the said statutory office.
The petitioner complained that due to non-functioning of Women Commission for the past two years, several atrocities and crimes were committed against women in the State and the perpetrators of the atrocities and crimes against women were left scot free. While stating so, the petitioner further stated that Rekha Sharma, Chairperson of the National Commission for Women, also spoke to the Chief Secretary of the State and that after retirement of Tripurna Venkataratnam in July 2018 no Chairperson has been appointed to Telangana Commission for Women. The petitioner also contended that 46 complaints were pending before the Commission without any action against the offenders. The matter will be heard by the panel next week.
The said panel adjourned to Tuesday a PIL filed by Dr P Bhagavantha Rao for hearing on the Niloufer Hospital dietician case. The matter was adjourned by a day as the counter affidavit filed by the State could not be brought on record during hearing. The PIL is filed challenging inaction of the Medical Health and Family Welfare Department in not terminating the services of the Diet Contractor of Niloufer Hospital, Koduri Suresh Babu and initiating criminal action against him on charges of largescale misappropriation of funds.
The petitioner urged the court to immediately terminate the services of the Koduri Suresh Babu as the Diet Contractor for Niloufer Hospital and to order an investigation by the Police/CID into the complete modus operandi into the scam which has been carried out by the petitioner and others to bring out the correct facts of the case. The petitioner sought directions to initiate criminal proceedings against the Diet Contractor and all the other accused persons for misappropriation of government funds and to initiate a fresh process of tendering to select a new diet contractor for Niloufer Hospital. The petitioner also sought directions to blacklist Koduri Suresh Babu from participating in any further tenders of for food supply at the Government Hospitals in the State of Telangana.
Justice Abhinand Kumar Shavili of the Telangana High Court directed the State to consider for promotion the petitioners for the post of Deputy Superintendent of Police if they are otherwise eligible. The order came in a writ plea filed by E Ravi Kiran Reddy and 25 other aspirants to be promoted to the rank. According to the petitioners government had followed the seniority list till 1762 and when they were in the list next due for promotion the government decided to go affect batch wise promotions. This they claim is illegal and unjust. The judge admitted the writ plea and made the order.
Justice K. Lakshman of Telangana High Court reserved his verdict in a batch of cases filed by Potluri Vara Prasad, chairman and MD of PVP Ventures. An FIR is registered against him on a complaint by Vikram Kailas and another by Shruti Reddy the neighbour of Vikram Kailas. According to the complaints, the accused is a developer of villa properties and that he had trespassed into the properties of the complainant and also threatened to demolish their properties. Senior Counsel V Venkataramana appearing for the accused said that the charges are false and that in fact the petitioner was not a villa developer. Appearing for the complainants, senior counsel T Niranjan Reddy alongside the State PP pointed out that the accused is not cooperating with the investigation in the matter. He said that the petitioner was taking advantage of an interim order of the court which said “no coercive steps” be taken against him. The public prosecutor pointed out that 7 witnesses had been so far examined and the petitioner had not joined the investigation.
