Avoid delay in matrimonial disputes: Telangana High Court

Hyderabad: A two-judge Bench of the Telangana High Court asked Family Courts in the State to avoid long adjournments in matrimonial disputes. The Bench, comprising Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavili, was dealing with a writ petition filed by one Syed Ahmed Moinuddin Jaffer and others against the action of Addl Family Court Judge, Hyderabad in not disposing of criminal petitions pending before him. The petitioner contended that cases pertaining to the matrimonial disputes are pending for a long time. The Bench directed the presiding officer to decide the matters as early as possible and also directed not to grant adjournment more than 15 days. If the matters are adjourned beyond the specified period, reasons should be recorded, the Bench said.
Manual scavenging
The Bench clubbed two writ pleas filed in the public interest on manual scavenging. The Bench heard a PIL filed by S Jeevan Kumar seeking direction against Hyderabad Metropolitan Water Supply and Sewerage Board and the GHMC Commissioner to carry out medical checkups for all sewerage workers and prohibit the practice of employing workers to clean the drains and manholes. The petitioner contended that a similar case with regard to the death of two sanitation workers while cleaning a septic tank at Kondapur in November 2021 was pending before the court. The Bench, while adjourning the matter, voiced concern for those who sacrifice their lives for the well being of others.
Protecting of assets
The same Bench directed the Special Government Pleader of Endowments Department to file a counter in connection with maintenance and protection of assets of temples/churches etc in Nizamabad district. The Bench was treating a letter addressed by the Principal District Judge Nizamabad to it as a suo moto PIL. The Bench also took up a report of Secretary District Legal Services Authority in connection with the maintenance and protection of assets. The letter and the report also dealt with encroachments of a mandapam, lack of facilities among others. The Bench, while granting time to the government to respond, adjourned the matter to July 5.
Status report
The same Bench disposed of PILs filed by T Rajnikanth Reddy, a practising advocate and other against the State Roads and Building and Forest Department for felling 50-year-old tress near Rangareddy Gudem. The petitioners questioned the felling of trees and laying a pipeline without obtaining permission from the competent authority. Counsel for the State contended that an agreement was executed by the government with the contractors and permission was accorded. The counsel pointed out that the total number of saplings planted were in line with the number of trees felled. The Bench, while disposing of the PILs, directed the Forest Department to submit the status report to the Registrar of the High Court.
