Hyderabad: A two judge panel of the Telangana High Court comprising Chief Justice Satish Chandra Sharma and Justice N Tukaramji on Wednesday granted six weeks to the State government to come up with a stated policy on collection of fees by private schools in the State. The Panel is hearing a batch of writ pleas filed by the Hyderabad School Parents Association complaining of huge fees being collected by certain schools and that the State government had failed in its duty to ensure that excessive fees is not levied and collected. The petitioners also complained against schools with misleading names such as IIT Olympiad, Concept E techno among others.
Retail liquor shops
The same panel adjourned for hearing a PIL filed by Telangana Republican Party challenging the action of the State Prohibition and Excise Department for allotment of retail liquor shops in the State for License period starting from 1st of December 2021 till 30th November 2023 as per GO issued by State on 5th November 2021 .The petitioner also challenged the action of the Department of Social and Tribal Welfare in allowing the same. The petitioner sought consequential direction to the Excise officials to allot licence to the retail liquor shops in the State for the said period to ensure livelihood, security and for the economic uplift of SCs and STs.
Power from garbage
The same panel granted 3-weeks time to GHMC to file its counter in a PIL filed by Kongar Saida Rao challenging the action of the Municipal and Health Authorities in not taking any action against Ramky Enviro and KKR Groups in not pursing the terms of the Memorandum of Understanding in generating power from garbage collected in twin cities since 2004-2005 and causing untold hardships to the citizens. The petitioner alleged that the State authorities are showing lenience which is highly objectionable. The petitioner also sought for a direction to the State Authorities to make alternative arrangements for disposal of garbage and turn it into raw material for power generation.
Write petition dismissed
A two judge panel of the Telangana High Court comprising Chief Justice Satish Chandra Sharma and Justice N Tukaramji on Monday dismissed a writ petition filed by Cyber City Computers to declare the second proviso to Rule 52 of Telangana Protection of Depositors Financial Establishment Act 1999 as illegal and to quash the same. The petitioner also sought for a direction to the Home Department from giving effect to the said proviso in respect to the prosecutions initiated prior to 24th March 2017 i.e the date on which officers not below the rank of Inspector of Police were notified as competent authority under Act 17 of 1999.
Legal Services Authority
Justice Shahmeem Akhtar of the High Court on Wednesday imposed costs of Rs 1 lakh to the Legal Services Authority on a septuagenarian while dismissing his writ petition. M Parthasarthy questioned an order of the Enforcement and Vigilance wing of GHMC in requiring him to vacate a premise he had unauthorisedly occupied. The property is situated near the Victoria Memorial Orphanage at HUDA Colony in Saroornagar. Sampath Prabhakar Reddy, counsel for GHMC would point out that the petitioner has occupied approximate 110 sq. yards of road land and part under the pretext that it was a dead end. A 20ft road to a length of 40 ft. was under his illegal occupation for about 3 decades. He would point out that it was a duty caste on the Enforcement & Vigilance Wing to stop such unauthorised construction on a public road.
