Compensation in Case of Death
If a workplace accident or injury causes the death of the employee, then his dependents will be entitled to compensation as follows:
50% of the monthly wages x relevant factor
OR
₹1,20,000, whichever is more.
Compensation for Permanent Total Disability
Suppose an accident at the place of employment leads to permanent total disability, such as losing both hands or both legs, then the injury settlement will be
60% of the monthly wages x relevant factor
OR
₹1,20,000, whichever is more.
Compensation for Permanent Partial Disability
Suppose there is a permanent but partial disability due to an accident or injury at the place of employment. In that case, the injury compensation will be calculated similarly to the permanent total disability and adjusted for the percentage mentioned in Schedule II of Part I of the Act.
For example, if the compensation for permanent total disability is ₹20,00,000 and the disability percentage in the schedule is 40%, the compensation will be ₹8,00,000 (40% of ₹ 20,00,000).
Compensation for Temporary Total/Partial Disability
If the employee has a temporary total or partial disability from a workplace injury, they will receive compensation, which is 25% of their monthly salary. The compensation is paid out bi-weekly (every 15 days) for a maximum period of 5 years.
