Calculating Injury Settlement Under Workmen’s Compensation

Thus, to compensate the workers adequately, the settlement calculation under the labour insurance policy is done as per the nature of the injuries.

Compensation in Case of Death

If a workplace accident or injury causes the death of the employee, then his dependents will be entitled to compensation as follows:

50% of the monthly wages x relevant factor

OR

₹1,20,000, whichever is more.

Compensation for Permanent Total Disability

Suppose an accident at the place of employment leads to permanent total disability, such as losing both hands or both legs, then the injury settlement will be

60% of the monthly wages x relevant factor

OR

₹1,20,000, whichever is more.

Compensation for Permanent Partial Disability

Suppose there is a permanent but partial disability due to an accident or injury at the place of employment. In that case, the injury compensation will be calculated similarly to the permanent total disability and adjusted for the percentage mentioned in Schedule II of Part I of the Act.

For example, if the compensation for permanent total disability is ₹20,00,000 and the disability percentage in the schedule is 40%, the compensation will be ₹8,00,000 (40% of ₹ 20,00,000).

Compensation for Temporary Total/Partial Disability

If the employee has a temporary total or partial disability from a workplace injury, they will receive compensation, which is 25% of their monthly salary. The compensation is paid out bi-weekly (every 15 days) for a maximum period of 5 years.

Before calculating the injury compensation, it is crucial to know the factors that play a key role in its determination.

  • Lost Wages- While calculating the injury settlement compensation, the employee’s lost wages are estimated based on his monthly earnings. It helps to calculate a fair amount of compensation to help the employee manage his expenses and attain financial stability during his unemployment.
  • Nature and Severity of the Injury- The amount of injury compensation also depends on the nature and severity of the injury. For example, the compensation for permanent total disability is higher than temporary disability due to its severity and impact.
  • Monthly Wages- The employee’s salary is also a crucial factor in determining the settlement compensation. Their salary component reflects their earning capacity and standard of living. Thus, the compensation is calculated accordingly.
  • Employee Age- While calculating the injury settlement amount, the employee’s age plays a major role since the remaining work years impact the compensation. The lower the age of the employee, the higher the compensation and vice versa.
  • Absence Duration- The length of absence of the worker from work directly influences their compensation amount. Since the injury settlement amount aims to compensate the employee while being unable to work, a longer absence period means more compensation and vice versa.
