Telangana HC asks Gadwal Municipal Commissioner to refrain from interfering with petitioner’s property

As per petitioner Venugopal, the municipal authorities grossly disregarded due process, acting without issuing any reasoned orders

Hyderabad: Justice B Vijaysen Reddy of the Telangana High Court has issued a directive restraining Municipal Commissioner of Gadwal from interfering with the property of a petitioner G Venugopal.

Venugopal had filed a writ petition challenging the actions of municipal authorities who demolished the compound wall of his property and dismantled a closed well located within his premises.


In his submission, petitioner’s counsel S Goutham contended that the municipal authorities had grossly disregarded due process, acting without issuing any reasoned orders despite the petitioner’s submission of a detailed response. The counsel further argued that the authorities had earlier instructed the petitioner to fill the well and construct a compound wall to avoid any inconvenience to the public, a request with which the petitioner had duly complied.

However, in January 2025, the authorities issued a notice alleging illegal encroachment of the well and pollution caused to the indoor stadium by waste emitted from Ananta Function Hall, which is also owned by the petitioner.

The petitioner responded to the notice; however, the authorities proceeded with actions against the petitioner without considering the response, failing to issue any reasoned orders or demolition notices, thereby violating legal procedures and principles of natural justice.

Agreeing with the arguments presented by the petitioner’s counsel, Justice Reddy granted interim relief, directing the municipal authorities to refrain from interfering with the petitioner’s property in contravention of the law.
