Telangana HC tells State govt to prevent illegal constructions
HC panel was dealing with a suo moto writ petition and a letter by Bar Council Chairman

Hyderabad: A full judge bench of Telangana High Court comprising Chief Justice Hima Kohli, Justice MS Ramachandra Rao and Justice Rajashekar Rao directed the State government to prevent any unauthorised construction or illegal construction taking place across the State.
The panel was dealing with a suo moto writ petition and a letter by Bar Council Chairman. The latter informed the court that the advocates could not appear before the court due the second wave of the pandemic. A clarification was sought by the State government from the High Court since in the previous order, the State authorities were directed to refrain from demolishing structures or evicting any person. The Chief Justice said: “All officers must be active on the ground and the government is free to take any preventive steps with respect to FTL and buffer zones,” upon a concern raised that certain persons were taking undue advantage of the earlier order. The same order has been extended till July 16 and the matter has been adjourned to July 15 for further hearing.
Case adjourned
A two-judge panel of Telangana High Court comprising Chief Justice Hima Kohli and Justice B Vijaysen Reddy on Monday directed Yellandu Municipality from making allotment of any of the sheds it proceeded to construct on demolition of a school.
The panel was dealing with a public interest litigation filed by Padidala Naveen questioning the high handedness in demolishing the local government school compound wall and the construction of commercial shutters. It was observed that commercial shutters were being constructed in the Zilla Parishad High School. Sheds were to be allotted to street vendors but have not been done so far. The panel took serious view of the matter and questioned the Municipality pertaining to how they could acquire the properties without following the due procedure. The matter has been adjourned to September.
Advocates association told to hold elections
Justice Amarnath Goud directed Telangana High Court Advocates Association to conduct elections to its executive committee on June 30 as notified under the election notification dated June 17.
Poonam Ashok Goud, a practising advocate and contestant for the president post in the elections, filed this writ petition challenging the decision of the Association in changing the election schedule. It is stated that some of the contestants raised serious questions about the credibility of the e-portal for the election. The judge upheld the contentions of Poonam Ashok Goud that once the date for the elections are notified they should not ordinarily be postponed. He accordingly passed interim orders directing the Election Officer and Advocates Association to proceed with the online elections.
