Telangana High Court questions eligibility criteria for junior civil judges

Hyderabad: A two-judge panel of the Telangana High Court comprising Chief Justice Satish Chandra Sharma and Justice N Tukaramji directed the Telangana High Court Registry to place before it rules and practices followed by other HCs in appointing Junior Civil Judges.
Law graduates filed a batch of writ petitions questioning the qualification of three-year advocate experience, minimum age qualification of 25 years and the rule obligating merit in law degree for the unenrolled candidates. The petitioners contended that the age criterion was unjust as most of the law students complete their graduation at the age of 25 years. As pointed out by the petitioners, the panel questioned as to why the three-year practice as advocate was mandated despite the acceptance of the Shetty Commission recommendations by the apex court. To the uninitiated, the SC had directed all the High Courts and State governments to amend their rules so as to enable a fresh law graduate who had not even put in three years of practice to be eligible to compete and enter the judicial service. Nalin Kumar, counsel representing the High Court Registry, submitted that a similar practice existed in Maharashtra and the same was upheld by the Bombay High Court.
Panel disposes of PIL
The same panel disposed of a public interest litigation case filed by Alla Ramakrishna Reddy, a YSRCP leader of Andhra Pradesh. It was contended that former DGP of Andhra Pradesh Ram Parvesh Thakur had encroached GHMC park land for making illegal constructions including an over bridge towards southern and eastern side of plot bearing No 149 Prashan Nagar Society, Jubilee Hills. The inaction of the State municipal authorities was challenged. On Friday, the authorities submitted that there was no such encroachment in the said area. The panel directed that GHMC shall ensure that no such encroachment takes place in the said spot or elsewhere, and then disposed of the case.
Hearing adjourned
Justice K Lakshman of Telangana High Court on Friday directed the State Police not to arrest Saranala Sreedhar of Sandhya Constructions and Estates. The order was granted for a period of two months while dealing with a quash petition filed by Sreedhar. The petitioner is facing allegations in multiple complaints for allegedly cheating property purchasers. He is also facing allegations of threatening purchasers and taking back the sold properties by forceful registrations. The petitioner submitted that multiple cases were booked with false intentions and said that all the issues were being sorted. The judge adjourned the case by two months for further hearing.
