Hyderabad: A two-judge Bench of the Telangana High Court comprising Chief justice Satish Chandra Sharma and Justice B Vijaysen Reddy on Monday disposed of a contempt petition filed against Principal Secretary Revenue, Somesh Kumar as well as the district Collector and RDO Vikarabad. The contempt was filed for non-compliance of orders of the High Court to issue pattadar passbook and title deeds to one P Laxminarayana Reddy with respect to 4 acres in Yenkepall village, Mominpur mandal under ex-servicemen quota. The Special GP stated that the process for issuance of the pattadar passbook had been initiated and it will be issued in 4 weeks.
The court further directed the petitioner to submit a proper application on the Dharani portal and directed the State government to issue a passbook and title deed within four weeks thereafter. The contempt petition was disposed of accordingly.
Statue in public places
A two-judge Bench of the Telangana High Court comprising Chief Justice Satish Chandra Sharma and Justice N Tukaramji directed the State government to ensure that no statue should be erected in public places. The Bench was dealing with a PIL filed by Allika Anjaiah challenging the inaction of the Khammam district Collector and the Municipal Commissioner in erecting ‘Cross of Jesus’ allegedly in the middle of a public road by some persons. The petitioner contended that municipal authorities failed in taking any action against the individuals contrary to the guidelines of the Supreme Court. It was pointed out on behalf of the State that the Special task force, which is competent to look into the matter was not made the party. However, the Bench made a note that the municipal authorities have already been made a party and directed the State government to ensure that no statue should be erected in such public places.
Misappropriation of funds
The Bench heard a PIL challenging the inaction of the Jangaon district Collector against the Narayanpuram Gram Panchayat sarpanch for misappropriation of panchayat funds. The GP Panchayat Raj and Rural Development said that action has been initiated by Collector against the sarpanch under law. The Bench, while making note of the same directed the petitioner to take recourse under the mechanism provided in the Panchayat Raj Act as well as Lokayukta Act, while disposing of the PIL.
Illegal mining
The Bench directed the State Pollution Control board to file its counter by 4 January 2022 in a writ petition filed by Vakkanti Koteswar Rao against the illegal mining activities allegedly being carried out by Deccan Cement Ltd. The petitioner contended that the State authorities are turning a blind eye towards the illegal mining being carried out at Saidulnama Reserve Forest, Mahankaligudem village, over an extent of 73 .93 hectors. The petitioner also sought for quashing the mining permission accorded to Deccan Cement Ltd as they violate environment and forest clearances.
Fire safety measures
The Bench posted a PIL filed by Khaja Aijazuddin for a hearing to January. The petitioner filed the PIL seeking directions to the State authorities to prosecute the President and Office Bearers of Exhibition Society for not complying with fire safety measures and for not obtaining the No Objection Certificate as mandated. The petitioner also sought for transfer of the accident cases which was registered at Begum Bazaar Police Station to CBCID or for constitution of SIT seeking prosecution against the office bearers of Exhibition Society under the provisions of IPC. The special GP appearing on behalf of the State said that applications are pending before authorities are concerned. The Bench posted the matter to January 2022.
