Hyderabad: A two-judge Bench of the Telangana High Court comprising Justice A Rajashekhar Reddy and Justice T Vinod Kumar expressed dissatisfaction at the government and GHMC for not filing their response to a public interest litigation case filed by one Naresh complaining about the poor state of civic amenities and sanitation in twin cities. The petitioner, in a 50-page affidavit, detailed about the sewage issues, potholes and other traffic issues. The panel, observing that time and again the authorities are failing to file their response despite fixing a time by court, commented that the court cannot wait for 4 years for officials response. The court granted two weeks for the government to file its response and adjourned the case.
Stay on construction of crematorium
The same Bench issued a slew of interim directions to the civic authorities and the government restricting them from constructing crematorium and dumping yard in the Full Tank Level (FTL) area of the Akkampally reservoir of Nalgonda district. The petitioner, Ramavath Pandu, complained that the Nalgonda district Collector, in an order issued on July 2021, directed the Engineering Department to go ahead with the construction of the crematorium in the SLBC land. The petitioner pointed out that the said order is contrary to the gram panchayat resolution. The panel stayed the construction.
Seeks Centre’s response
The same Bench of the Telangana High Court directed the Central government to respond to a writ plea complaining of inaction in the appointment of Vice Chairman/ Judicial member to the Railways Claim Tribunal. The panel was dealing with a petition filed by the Railway Claim Tribunal Advocates Association complaining that the claim against the Railways are to be adjudicated by the Tribunal but the authorities are not appointing the Vice Chairman/ Judicial member to the Railways Claim Tribunal at Secunderabad. The panel also directed the Assistant Solicitor General to inform the court as to which department is required to take a decision in this regard.
Forest official appears before court
The Divisional Forest Officer North Division Warangal appeared before the Bench in the High court in response to a notice of contempt of court. Justice Amarnath Goud of the Telangana High Court had directed Aparna IFS, the Divisional Forest Officer, North Division Warangal to file a counter detailing her explanation for the violation of court order. One Neerja Devi and 7 others of the Dharamsagar mandal filed a case challenging the court order by the officer. Earlier, the court directed the Forest Department not to interfere with the possession of the petitioner’s land. The official, who was present before the court in person, said that they didn’t violate the court order. The judge directed the officer to detail her explanation in an affidavit and adjourned the case to October 18.
