Sangareddy: Acting tough on a bank for delay in reversing a failed ATM transaction, the Consumer Forum, Sangareddy, instructed the Corporation Bank, which has been merged with Union Bank of India, to pay Rs 10,000 with 12 per cent interest as compensation for 3 years’ delay besides paying Rs 5,000 to the customer towards his cost of litigation as the amount debited was not credited by the bank which had promised to do so.
Momula Rajendar, a resident of MRF Colony in Sangareddy, has been maintaining an account with Corporation Bank’s branch located at Roshini Complex in Sangareddy. On October 17, 2018, Rajendar attempted to withdraw Rs 10,000 cash from an Andhra Bank ATM located at the by-pass road in the town. However, the ATM failed to dispense the cash, but the same amount was debited from his account. When Rajendar approached the bank staff, they assured him that the amount would be credited to his account by saying that the deduction might occurred due to some mistake.
The bank management, however, failed to keep its promise. After more than two and half years of effort, Rajendar approached Consumer Forum and filed a complaint seeking justice under Consumers Protection Act. The case came up for hearing before the Forum on September 17, 2021. The advocate Ch Vidyasagar on behalf of Rajendar sought Rs 75,000 as compensation for causing mental agony to his client, Rs 10,000 towards lawyer’s fees besides paying Rajendar’s actual amount Rs 10,000 with interest.
After completion of arguments from both sides, the Consumers Forum President P Kasturi and Member D Sreedevi directed the Corporation Bank to pay Rs 10,000 cash with 12 per cent interest from the date of deduction and Rs 10,000 additional compensation for causing mental agony to the customer and Rs 5,000 towards litigation charges. On October 8, the Consumers Forum asked them to deposit the amount within 30 days. Rajendar said that he had finally got relief after three years of agony thanks to the Consumers Forum. Advocate Vidyasagar observed that such erring bank staffers deserve much bigger punishment.
