Hyderabad: Cabinet sub-committee on Dharani portal is learnt to have recommended issuing notices to persons concerned and give them time for filing objections in case there is need to carry out changes in wrongly entered pattadar’s name.
After enquiry, District Collectors will pass Speaking Orders and carry out corrections online. Similarly, it was noticed that the nature of land, classification or type were erroneously recorded in another category and were placed under autolock. Another module will be created for correcting entries related to patta lands which are wrongly recorded as notional khata and placed in autolock.
About 34,666 grievances were received stating that a particular survey number or sub-division was not appearing in the website. During Land Records Updation Programme (LRUP), no pattadar passbooks could be issued for these sub-divisions and survey numbers. To carry out corrections, the District Collectors are likely to be authorised.
With regard to correcting variations in extent of land, the Dharani received over 16,000 grievances. While the issues can be addressed only during a comprehensive digital survey of land, the Cabinet sub-committee found that certain clerical mistakes needed to be corrected by referring to previous records. For the purpose, it has reportedly recommended to carry out a field survey initially and create a module available for rectifying these issues.
Though transactions by and in favour of multiple parties are legally permissible, the Dharani software currently supports only a single buyer and a single seller. Further, the buyer must be present and offer his/her biometrics during the agricultural land registration. Though it is legally permissible, there is no provision for purchases in representative capacity or Special Power of Attorney (SPA) by purchasers. The Cabinet sub-committee suggested creating new modules which enable transactions with multiple buyers/sellers and also allow buyers like NRIs or physically challenged persons to be represented by others through legal provisions like SPA.
Occupancy Rights Certificate
The sub-committee also recommended for a provision for incorporation of fresh Occupancy Rights Certificate (ORC) or the protected tenants (PT) certificates on a case-to-case basis. It was suggested to create a module to merge two or more khatas of a pattadar in the same village. A succession module was suggested for lands in agency areas, apart from modifying the existing module of General Power of Attorney (GPA) where the pattadar passbook number of the executants is unavailable.
To provide better services to agricultural land owners and address their grievances, the Cabinet sub-committee has recommended for setting up Dharani Helpdesk in every Collectorate and deploy trained revenue as well as technical officials. It has suggested for conducting comprehensive training programmes on Dharani for the District Collectors, Additional Collectors, Tahsildars, Deputy Tahsildars, Dharani data entry operators and MeeSeva operators. The Collectors were advised to organise awareness programmes for all elected representatives on the existing modules of Dharani portal.
As per the recommendations, a link will be provided in Dharani to access encumbrance certificates (EC) on CARD portal, related to registrations taken up prior to the website’s launch. A separate module was suggested to cancel transactions that took place prior to Dharani launch. Another module will be developed to enable pattadars to get certified copies of Dharani registered documents at MeeSeva centres upon payment of nominal fee.
More than one lakh applications were received against erroneous inclusion of sub-divisions in prohibited list of lands where 84,949 applications have been disposed of. The District Collectors already took a suo moto activity and examined about 6,327 villages where they removed over 1.81 lakh sub-divisions covering an extent of 1.74 lakh acres. The Cabinet sub-committee wanted the Collectors to complete the exercise expeditiously. It has also suggested for making a module available for the Collectors to add or modify sub-divisions from the prohibited list. It has also suggested for a study of legal issues with regard to writ petitions pending in the High Court and also software issues by experts to suggest improvements.
