A bench of Justices BV Nagarathna and Ujjal Bhuyan while reserving its order on a batch of pleas filed against the remission granted to 11 convicts also asked the government of Centre and Gujarat to submit original records by October 16
Advocate Shobha Gupta, appearing for Bano, stressed that the three vital factors – the nature of crime, impact on the society at large and the precedent value – were not not taken into account while passing the remission orders.
A bench comprising Justices BV Nagarathna and Ujjal Bhuyan remarked that there are some convicts who are more privileged as usually cases are filed against denial of early release
The Gujarat government had released all 11 convicts in Bilkis Bano case on the basis of the 1992 remission policy and not the policy adopted in 2014, which is now in force
