Hyderabad: A two-judge panel of Telangana High Court comprising Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavili on Tuesday heard a PIL filed by Sree Rastriya Vanara Sena against government in initiating land acquisition proceedings proposing to acquire the land in Seetharampur village of Shabad mandal in Rangareddy admeasuring Ac 1148.12 gts belonging to Sree Seetha Rama Swamy temple. The petitioner contended that there was a legal bar on the government from acquiring lands belonging to religious institutions. The panel, while ordering notice, directed the Additional Advocate General to get instruction why the government wants to take the temple land and posted the matter to next week.
PIL disposed of
The same panel disposed of a PIL seeking allotment of Ac 500 guntas of land for a Muslim graveyard in Ramanthapur locality. The PIL was filed by Jahangir Pasha SK. The petitioner contended that there was no graveyard for the community people and there was acute shortage of land for the purpose of burial and therefore he had made representation to the government. The panel while disposing of the PIL directed Medchal-Malkajgiri Collector to consider his representation dated December 22 within three months.
‘Pay compensation’
The same panel on Tuesday directed Commissioner of Greater Hyderabad Municipal Corporation that compensation should be paid within two weeks and appointment orders shall be given to the family members of two sanitation workers. The PIL was taken on record based on a news item sent by Justice Ujjal Bhuyan published in an English daily. The incident happened when four sanitation workers went to clean a septic tank of an apartment. In the course of cleaning operations, two sanitation workers died and two of them were admitted to hospital as their condition was critical. The court opined that such acts were very unfortunate and occurring even after enactment of Prohibition of Employment as Manual Scavengers and their Rehabilitation Act 2013. It also opined that the Supreme Court in many cases had directed for payment of compensation of Rs 10 lakh to family members of each of the deceased besides directing rehabilitation of manual scavengers and their family members. The panel directed the GHMC authorities to implement the order within two weeks. In the event of the order not being complied with the GHMC Commissioner has to be present before the Court at the next date of hearing.
Petitioner told to file rejoinder
The panel directed petitioner G Vinod Kumar to file his rejoinder in a PIL filed by him challenging inaction of the State authorities to take steps to protect Hindu burial grounds in Kandikal village of Bandiaguda mandal in Hyderabad which was handed over to the GHMC by Revenue authorities. The petitioner alleged that the GHMC failed to protect the same.
There were several illegal constructions taking place on the said land which had to be demolished. The panel posted the matter to February for hearing.
