Hyderabad: A two-judge panel of the Telangana High Court on Wednesday suspended the transfer of a Hindi pandit on the grounds of discrimination by the State government. Suguna Bai, a Hindi pandit from Adilabad, a widow, was transferred to Asifabad. The panel reasoned that the constitution of new districts necessitated transfers but faulted the classification of widows in the transfer list as widows appointed on compassionate appointments were exempt from transfers. The panel accordingly suspended the transfer and directed her continuance in the same post.
Transfer of IPS officer
The same panel posted before another panel a writ plea involving the transfer of IPS officer Abhishek Mohanty. Earlier, Mohanty had challenged his allotment to Andhra Pradesh before the Central Administrative Tribunal successfully. The Tribunal also took note of the fact that there were vacancies in Telangana and yet the officer was not being accommodated. The Central Government challenged the order as being contrary to the law. It specifically pointed out that the allotment is in accordance with the guidelines of the high-power committee constituted at the time of State bifurcation for the purpose of allotment of staff between the two States. The panel headed by the Chief Justice noticed that a batch of similar cases is being considered by a panel headed by Justice Ujwal Bhuyan and directed the matter to be posted there.
Suspension of Sarpanch
Justice A Abhishek Reddy of the Telangana High Court on Wednesday reserved orders on a writ petition challenging the suspension of Sarpanch of Khammampally village. Md Jasmin of Khammampally village had filed a case seeking directions to revoke a three-month suspension order issued against her. She said she was not given an opportunity to explain her side before passing the order of suspension. Even the report on which suspension orders were issued were not provided, depriving her of the reasons for the suspension, the petitioner said. The Assistant Government Pleader representing the Panchayat Raj department argued that the suspension orders were issued pending enquiry and the same will be conducted before passing the final order. After hearing both sides at length, the judge reserved the case for orders.
SCCL worker
The panel on Wednesday disposed of a Public Interest Litigation filed by I Srinivas, a worker in Singareni Collieries Co Ltd. The PIL was filed to take action against the irregularities committed by the Forest Range Officer, Revenue Divisonal Officer, Tahsildar and other public servants of Mancherial district. The court while disposing of the case gave liberty to the petitioner to approach State Lokayukta or file criminal complaints against the officers.
