Panel dismisses pleas on Group II results

Hyderabad: A two-judge panel of the Telangana High Court, comprising Chief Justice Hima Kohli and Justice B Vijaysen Reddy, on Monday dismissed a batch of writ pleas on the results of Group-II services examinations conducted by the Public Service Commission. The Panel was dealing with divergent opinions of two earlier division benches court. The controversy relates to incorrect/erroneous bubbling, double and absence of bubbling, etc while evaluating the results.
The candidates argued that there were faulty, contradictory instructions leading to re-evaluation. In the course of the said process, two panels of the court took opposite views. The panel referred to various other judgements, particularly one of the Supreme Court, and held that the High Court could not have overlooked the mandatory nature of instructions issued by the Commission and its binding nature on the candidates.
The panel held that there can be no empathy or sympathy by the High Court in such matters and held that the candidates should have correctly read the instructions and acted accordingly with regard to their personal details, hall ticket numbers etc. Further, there can be no exception to the instructions. Once the entries are filled inaccurately, ‘there can be no exception to the instructions’. The court opined that it could not give instructions to the Public Service Commission to manually inspect or evaluate the answer sheets. The Bench took cognizance of the fact that the careers of many were put on hold for no fault of theirs and dismissed the batch of writ pleas.
Admission to engineering colleges
The panel also heard a batch of pleas on admission to engineering colleges under the ‘Convenor Quota’. The pleas were filed by several colleges questioning the decision of the Telangana State Council for Higher Education which proceeded to do the counselling under the ‘lateral entry into 2nd year’ quota as spot admissions. The Managements in a common cause contend that the action by state authority infringed on their right of making admissions under the convenor quota and was resultantly illegal. The panel will hear the matter on September 7.
Pollution report sought
The panel also directed the Telangana Pollution Control Board to file a fresh status report on the level of pollution of groundwater in the Jeedimetla area. It was dealing with a suo moto writ petition based on a news item in a Telugu daily published in December 2019. According to the said news item, chemical industries located in and around Jeedimetla were responsible for pollution of ground water. The article pointed to the presence of arsenic metals nickel-cadmium and chemicals. It also referred to a pungent odour in the atmosphere. The TPCB submitted a report showing closure of 40 companies and closure notice to another 220. The panel extended the time to the Board to submit its report of what it has done to the other closure notices.
