Telangana HC seeks factual report on Batasingaram

Hyderabad: A two Bench of the High Court comprising Chief Justice Satish Chander Sharma and Justice A Rajashekar Reddy on Tuesday appointed senior counsel K Vinay Kumar to inspect and report to the court about the facilities made available for traders at Batasingaram.
The Bench informed that the traders and merchants will continue under the present dispensation till further orders. In their petition, fruit merchants associations contended that the officials were acting in a high handed manner and alleged that the officials were stalling them from carrying on their business at Gadiannaram contrary to the interim arrangement made by a single judge.
Meanwhile, Special Government Pleader Sanjeev Kumar argued that all arrangements have been made at the new location. He also pointed out that most of the fruit vendors had agreed and shifted to Batasingaram. With both sides making conflicting claims on the facilities available at Batasingaram, the Bench asked the senior counsel to visit the location and submit a factual report.
Compassionate appointment The same Bench refused to entertain a writ appeal of TS Transco on employing a tribal woman on compassionate grounds. Earlier Kodavath Kesi filed a writ petition challenging the action of the distribution company for not considering her application for appointment on compassionate grounds.
In April 2003, Kodavath Kesi’s husband was electrocuted while discharging his duties. The Bench pointed out that the petitioner was indeed entitled to be considered for employment on compassionate grounds as per the then prevalent scheme.
Discrimination in promotions The same Bench posted for final adjudication a writ petition challenging Rule 4 A and B pertaining to the services of jail superintendents in the State. The petitioner, Vijayalakshmi Srikanth, currently full in-charge Superintendent of women’s prison, pointed out that the rules provide for promotion from the cadre of Deputy Superintendent to Superintendent. The sub-rules provide for two categories based on gender.
However, only those who are male Deputy Superintendents are eligible for the post of Superintendents. In her writ plea, she contended that such a classification amounted to gender discrimination and was unconstitutional.
