Hyderabad: Justice Ujjal Bhuan of the Telangana High Court on Thursday announced that a criminal case filed against sitting Patancheru MLA Mahipal Reddy will be quashed. He reserved the writing of the verdict in a petition filed by the TRS MLA who is convicted of offences of criminal intimidation, trespass extortion, wrongful confinement of the complainant Chandu.
The quash petition comes as a rare exception when the petition to quash is filed after the conviction. However it is filed after entering into a compromise with the complainant. The complaint was filed in 2014 alleging that the accused committed the stated offences by forcibly entering the complainant’s factory to demand for compensation when a worker of the former had died.
The Additional JFCM at Sanga Reddy imposed a sentence of thirty months imprisonment on the MLA. During the pendency of the appeal the present petition is filed. Senior Counsel S. Niranjan Reddy pointed out that the Apex court had ruled that where the damage is to an individual and not to society parties can compromise the matter and in the said background the case must be quashed.
No relief to apartment owners in BMR Flats
Justice K. Lalita of the Telangana High court on Thursday refused any relief to occupants of persons living in flats constructed contrary to law. The judge dismissed a writ petition filed by 18 owners of flats constructed at Gauthami Colony near Kukatpally known as BMR Flats. The flat owners challenged the notices issued by the GHMC. Counsel B. Mahender Reddy argued that the petitioners were bonafide purchasers of the flats in question. Sampath Prabhaker counsel for GHMC pointed out to the court that the builder had obtained permission for stilt and two floors but proceeded to construct six floors. He also without the authority and contrary to law clubbed two independent permissions without leaving setbacks. He also argued that earlier when the civic authorities had sealed the properties in question the builder broke open the seals and was facing criminal charges. Dismissing the writ petitions the judge said that the violations were serious and that the action of the GHMC was in accordance with law and did not warrant interference by the court.
SHRC can not interfere in civil matters
A two judge panel consisting of Chief Justice Satish Chandra Sharma and Justice N. Tukaramji on Thursday suspended an order of the State Human Rights Commission (SHRC) directing restoration of water supply to a resident in the city. The panel is hearing a writ petition filed by C. Lakshmikanth and others challenging the orders passed by SHRC directing the authorities to restore water connection to the beneficiary at a flat at Sindhi colony in the city. Senior Counsel P. Venugopal appearing for the petitioner contended that it is purely a civil dispute between the private respondent and the petitioner and that the SHRC cannot entertain civil disputes and pass an order to immediately restore water connection.
Osmania General Hospital new building
The same panel was informed by the state Advocate General BS Prasad that the decision to construct a new hospital in the present space of Osmania Hospital is under consideration by a Committee to consider the same at the instance of the state government. The information was given to the panel in a batch of PIL cases filed by Osmania Medical College Alumni Association and others seeking a direction to the state government to construct a new multi storied building to house Osmania General Hospital which is in dilapidated condition even though the Government had sanctioned Rs 200 crore for the said purpose. The panel going into the question is expected to submit its report in the next fifteen days.
